Manifiesto: Nosotros Acusamos/We Accuse

El 24 de enero de 2012 el Tribunal Supremo de España ingresará definitivamente en la historia universal de la infamia: el juez Baltasar Garzón va a ser sometido a juicio por pretender investigar los crímenes del franquismo.

La impiadosa e inaudita persecución judicial que este juez está sufriendo excede a su persona. Sin perjuicio del odio visceral que trasluce el dislate jurídico que algunos magistrados han puesto en marcha, es el propósito de enterrar la posibilidad de juzgar dichos crímenes lo que explica el desafuero que están cometiendo.

Contraviniendo la Constitución, el Derecho Internacional, el Código Penal, la Ley de Enjuiciamiento Criminal y la doctrina de que un día supo hacer gala el propio Tribunal Supremo, miembros de este Tribunal se proponen inhabilitar a Garzón por cumplir lo que los mismos establecen.

Las consecuencias que ha tenido este insólito desmán judicial perturban y acongojan. En lo inmediato, la suspensión en sus funciones del juez, el absoluto desamparo para las víctimas, la paralización de toda investigación penal sobre uno de los mayores genocidios cometidos en el siglo pasado y la advertencia implícita a cualquier juez español que coincida con el sancionado. A más largo plazo, advierten que cuando median intereses materiales, ideológicos o políticos hay crímenes que no se investigan y criminales que no se juzgan.

Le imputan a Garzón haber dictado resoluciones injustas por haber tenido la osadía de pretender investigar crímenes que sólo se explica que aún no estén juzgados por la impunidad que se ampara en la Ley 46/1977 de 15 de octubre, de Amnistía, cuya declaración de nulidad ha sido instada por el Comité de Derechos Humanos de las Naciones Unidas, entre otros organismos internacionales, por ser violatoria de normas imperativas del derecho internacional y, por tanto, obligatorias para todos los Estados.

La Ley de Amnistía, en todo caso, sólo se refiere a la extinción de responsabilidad penal de los delitos cometidos con intencionalidad política. Ni de su texto se desprende que pretendiera albergar a quienes hubieran cometido crímenes lesivos para la humanidad ni, aunque así se lo hubiera propuesto o se quisiera interpretar, sería admisible. Salvo que se entienda, por ejemplo, que los nazis hubieran podido o pudieran ser eximidos de responsabilidad por estas causas.

En el colmo del despropósito, se trata del mismo Tribunal Supremo que juzgó - y condenó a más de mil años de prisión - al represor argentino Adolfo Scilingo por crímenes de lesa humanidad cometidos en Argentina sosteniendo que éstos pueden y deben ser enjuiciados por ofender a la comunidad internacional, siendo inhábiles cualesquiera leyes que los amparen. Ahora, cuando el mismo juez español que procesó a aquél pretendió investigar delitos de similar tenor cometidos por españoles contra españoles en España, algunos miembros de ese Tribunal lo acusan de prevaricador y van a juzgarlo.

La torcida interpretación de la ley de amnistía y la negativa judicial a juzgar estos hechos ilícitos no sólo sumen en el descrédito y la vergüenza, nacional e internacional, a la administración de justicia española, sino que desamparan a los cientos de miles de víctimas que en su día lucharon por defender la legalidad republicana y por eso sufrieron muerte, desaparición y destierro. Y a sus familiares que, pasados ya más de setenta y cinco años del comienzo de la acción criminal, deben seguir reclamando infructuosamente reparación y justicia.

En Alemania, Francia, Italia... se sigue juzgando a los genocidas nazi-fascistas por hechos cometidos aún antes de los que Garzón imputaba a los asesinos españoles. En Argentina, Chile, Uruguay... se juzga a criminales que pretendieron ser amparados con leyes que los exoneraban de responsabilidad penal.

Tras cuarenta años de dictadura y treinta y cinco de democracia, en España no existe siquiera una Comisión de la Verdad a modo de las que se instituyeron en numerosos países en los que se cometieron crímenes semejantes. Ni a un solo niño robado por la dictadura se le ha restituido su identidad; ni un solo victimario ha sido identificado judicialmente; ni a uno un juez le ha tomado declaración. No hay nadie, en fin, que haya sido imputado por la comisión de alguno de los múltiples, masivos y generalizados crímenes cometidos.

Los crímenes contra la humanidad cometidos por el franquismo pueden y deben ser juzgados.

Encubren estos crímenes quienes se niegan a investigarlos, calumnian quienes le atribuyen delito al juez que pretende hacerlo.

Hay prevaricadores, pero Garzón no es uno de ellos.

Los prevaricadores son los que se han opuesto a la investigación de los crímenes de la dictadura y los que contra este juez vienen dictando resoluciones manifiestamente injustas.

A ellos han de serles aplicadas las sanciones que el Código Penal prevé para quienes encubren delitos y prevarican. A esas penas deberán enfrentarse cuando cese el desvarío y el derecho y la justicia sean restablecidos. A ellos los acusamos.

WE ACCUSE

On January, 24th 2012 the Supreme Court in Spain will join definitely the universal history of the infamy: Judge Baltasar Garzón is going to be prosecuted for the sake of trying to investigaate the crimes of Franco period.

Teh irreligious and aoutrageous juridical prosecution that this judge is suffering is exceeding his person. Without any prejudice of the visc eral hatred that translates the juridical absurdity that some of the magistrates have started, it is the purpose of buring the possibility of judging said crimes which explains the outrage they are committing.

Infringing the Constitution, the International Right, the Criminal Code, (la Ley de Enjuiciamiento Criminal) and the doctrine thaat one day the Supreme Court knew how to take pride in , some members of this Court are proposing to inhabilitate Garzón for the sake of accomplishing what themselves are establishing.

The consequences that this unusual juicial misbehaviour have had, are disturbing and afflicting. At a first sight, the interruption of the Judge's job, the absolute helplessness for the victims, the paralization of every criminal investigation upon on of the main genocies committed during the previous century and the implicit advise to any Spanish judge that meets with the punished one. In a longer run, it is advised that in the middle of material interests, either ideological or political crimes are not investigated and criminal that are not judged.

Garzón is accused of having dictated unfair resolutions to dare to investigate crimes with the only explanation of not having already been judged because of the impunity sheltering by the Law of 46/1977, 15th October, of Amnesty, which declaration of nullity has been urged by Human Rights Commitee of United Nations, among other international organizations because it is violatery of imperative rules of international right and therefore obligatory for all the states.

The law of Amnesty in any case is only referring to the obliteration of criminal responsabilities of crimes committed with political intention. Neither in its text implies that pretends to shelter to those who had commited crimes harmfull to the humanity, neither although it had been their purpose, or it could be interpreted, would it be admissible at all. Unless it can be understood, as an example, that nazis could have been or could be realeased from any responsability due to these causes.

As a finishing touch to nonsense, we are dealing with the same Supreme Court which judged - and condemned to more than a thousand years in prison – to the Argentinian repressor Adolfo Scilingo, due to crims against humanity commited in Argentina, maintaining that these crimes can and must be judged as an attack to the international community, being unable any other law which protects them. Now when the same Spanish judge who sue the former, tried to investigate similar tenor crimes commited by Spaniards against Spaniards in Spain, some members of this Court accusse him of prevarication and they are going to judge him.

The twisted interpretation of the same law of amnesty and the judicial negative to judge this illicit facts not only sink the Spanish administration of justice in discredit and shame, either nationally or internationally, but renounce hundreds of thousands of victims that once fought for the republican legality and because of this they suffered death, disapearance and exile. And also to their relative that, more than 75 years elapsed of the beginning of the criminal action, they must countinue claiming for reparation and justice unfruitfully.

In Germany, France, Italy they continue judging to nazi-fascist guilty of genocide due to facts committed even before the ones that Garzón charged Spanish assassins. In Argentina, Chile, Uruguay they judge the criminals who tried to be sheltered by laws which released them from criminal liability.

After 40 years of dictatorship and 35 of democracy there is not even in Spain a Commission of Truth in the same way that was established in numerous countries in which similar crimes were committed. Not a single stolen child during dictatorship has given back his identity. Not a single assassin has been judicially identified, nor has been taken statement on a single one. There is nobody at last that has been accussed for the commission of any of the noumerous, massive and generalized committed crimes.

Crimes against humanity committed by Franco era should have and must be judged.

Those who deny the investigation of the crimes are concelaing them, those who try to impute the crime to the judge who try to investigate, they are defaming.

There are those who prevaricate, but Garzón is not one of them.

Prevaricators are the ones that have oposed to investigate the crimes during the dictatorship and those who are passing sentences obviously unfair against this judge.

It is to them that the penalties have to be charged as per the Criminal Code states for those who conceal crimes and prevaricate. When the craziness stops they must face those penalties and the right and the justice are restablished. We accuse them.
